Sonia Sotomayor, one of Barack Obama’s leftist appointments to the Supreme Court, has been in the news this week urging great respect for precedents.
She publicly warned that “caution” is a necessary element of the federal judiciary, “that overriding previous precedents risks undermining faith in the legal system,” according to a report in the Washington Examiner.
She cited the Dobbs decision from June, where a majority of the court determined that the faulty Roe v. Wade decision from 1973 needed to be rejected.
That ruling had created a “right” to abortion in the U.S. Constitution, which the Dobbs decision found did not exist. The ruling affected abortion in American only insofar that is allows states to regulate the lucrative industry, not the federal government.
Since then, some states have moved to restrict abortions. Others, like Colorado, are trying to turn themselves into a destination for those who want to kill their unborn.
Democrats there did that by simply declaring that the unborn in Colorado have no rights. Ever.
Explained Sotomayor, “Justices have to proceed with a great deal of caution because people rely on the stability of the law in believing and having faith that the judicial system is not prone to politics.”
She opposed the majority in the Dobbs ruling.

The Examiner reported, “Other members of the high court’s liberal bloc including Justice Elena Kagan have made subtle suggestions that the Supreme Court has brought its legitimacy into question by way of the recent landmark opinions determined by the 6-3 Republican-appointed majority on the bench.”
It was a few weeks ago she said, that “judges create legitimacy problems for themselves when they don’t act like courts” and “when they instead stray into places that look like politics.”
Whatever “politics” may be involved may, however, lean more the other direction for Sotomayor, since she openly advocated the demolition of the precedent of marriage between a man and a woman just a few years ago.
That precedent, however, was not the 49 years old like abortion. Marriage between a man and a woman has been the precedent for civilization for millennia.
In fact, during the arguments over marriage, in which the narrow liberal majority on the court at the time created a “right” to same-sex marriage, much like it created the abortion right years ago, Sotomayor said destroying the institution would not take any rights from anyone.
Many people, gay or straight, still would choose not to get married, she argued at the time.
Further, she also exhibited her agenda-driven ideology when she made the extraordinary claim that, “The right to be married is embedded in our Constitution.”
She said states cannot be allowed to prevent people from having a “fundamental” right.
The word “marriage,” however, is nowhere in the Constitution.
