Universal mail-in voting is unconstitutional, according to a ruling from the Delaware Supreme Court.
Just the News reported the decision found that the all-mail scheme recently adopted by lawmakers violates the state’s constitution.
The court’s determination found: “The Vote-by-Mail Statute impermissibly expands the categories of absentee voters identified in Article V, Section 4A of the Delaware Constitution. Therefore, the judgment of the Court of Chancery that the Vote-by-Mail Statute violates the Delaware Constitution should be affirmed.”
“This is a win for the rule of law in Delaware’s elections,” said President J. Christian Adams of the Public Interest Legal Foundation.
“This law violated the plain text of the Delaware Constitution that provides specific reasons people are allowed to cast absentee ballots and when voter registration can take place. If Delaware lawmakers want to have mail-in voting, they need to pass a constitutional amendment.”
It was just months ago the Delaware General Assembly passed a law permitting mail-in voting for any reason and same-day voter registration. PILF immediately sued.
The court also said, “The Same-Day Registration Statute conflicts with the provisions of Article V, Section 4 of the Delaware Constitution. Consequently, the judgment of the Court of Chancery that the Same-Day Registration Statute does not violate the Delaware Constitution should be reversed.”
Absentee voting is constitutional in Delaware, but there is expected to be a reason, such as illness or disability.
Just the News said, “Friday’s ruling is a blow to Democrats who have sought to make permanent COVID-19 era adjustments to the absentee voting process in a plethora of states.”
In fact, all-mail ballots were just one of the circumstances that developed during COVID that have cast doubt on American elections. Other factors include ballot drop boxes and the practice of “curing,” or fixing mistakes on mail ballots.
Further, evidence now shows the FBI influenced Big Tech to suppress accurate, but damaging information, about the Biden family’s international business operations just days before the election, which has led commentators to charge the bureau with changing the outcome from President Trump to Joe Biden.
Additionally, Mark Zuckerberg’s $400 million-plus that he handed out, through foundations, to mostly leftist local elections officials who used it to recruit votes from Democrat strongholds also is now considered to have unfairly influenced the election results.
