The leftists on the Colorado Court of Appeals admitted there were problems with the leftists who prosecuted and sent to prison former Mesa County Clerk Tina Peters.
They threw out her sentence.
Now the judge who imposed that now-lifted nine-year term for her efforts to document election records from the 2020 vote has claimed that he did nothing wrong, that his sentence was perfectly fine.
But Peters’ defense team has pointed out that the judge’s statement is “not true.”
For witnesses, plaintiffs and defendants in a courtroom, that could be called perjury.
Columnist Joe Hoft wrote about the situation as the state of Colorado tries to fix its egregious errors in Peters’ case by describing how Matthew Barrett, the sentencing judge, “is caught lying.”
Barrett defended his sentencing performance in a letter to Gov. Jared Polis, also a far-left activist.
“I chose a sentence in roughly the midpoint of the presumptive ranges that this state’s general assembly has set. My reasons for the punishment I chose [are] more specifically detailed in the remarks I made at her sentencing.”
Those remarks, his six-minute rant abusing Peters and making outside-the-judicial system accusations against her:
The column pointed out Peters’ defense team responded, “Judge Barrett’s assertion that he ‘chose a sentence in roughly the midpoint of the 2 presumptive ranges’ is not true. Judge Barrett made the sentences consecutive instead of concurrent, which is almost unheard of when multiple counts arise out of a single criminal episode. Judge Barrett imposed a sentence totaling eight years and [nine] months, instead of 3.5 years if the sentences ran concurrently, as most judges do.”
The commentary said the claim was in Barrett’s response to a resentencing process now going on.
It added, “Judge Barrett sentenced Tina Peters to prison after a hateful rage in court. This was one of the worst courtroom rants in U.S. history. The judge prevented Tina from providing evidence that supported her actions, ignored federal statutes like the Supremacy Clause as well as the actions of Federal employees like AG Garland and FBI Head Wray, who joined a conference call regarding Tina before her arrest.”
The judge, in fact, inexplicably verbally added accusations, without evidence, of Peters being a “charlatan,” trying to “pedal (sic) a snake oil,” preaching “lies,” “undermining” elections,
Peters defenders asked the judge to be tossed off the case because he is “unashamed of his actual prejudice against” her.
Her lawyers now are working on an appeal to the state Supreme Court, which has gone so far in its support of Democrat politics the members tried to ban President Trump from the 2020 election ballot before being slapped down by the U.S. Supreme Court.
She is behind bars over a “security breach” in her office during the 2020 elections.
The Court of Appeals affirmed her conviction but ordered a resentencing. Her defense team has asked Barrett be removed.
Reports confirm the security breach involved pursuit of evidence of fraud. That election, in fact, was beset by a long list of factors each of which could have introduced fraud into the process.
Gov. Jared Polis has admitted the sentencing was egregious, because he noted one of his friends was convicted on similar charges and given on a slap on the wrist. But he has refused to act in Peters’ case.
WorldNetDaily reported when the appellate court found the sentencing judge violated the Constitution by lashing out at Peters for exercising her free speech rights.

Polis has been under pressure in the Peters case since before President Donald Trump granted her a full pardon. At the time, Colorado officials said Peters was convicted of a state offense regarding election system integrity so Trump’s decision didn’t matter.
Peters’ intent apparently was to preserve records from the 2020 presidential election vote.
Curiously, Jena Griswold, the state’s current secretary of state, a Democrat, was found to have posted hundreds of election system passwords online, and she was not even reprimanded, much less prosecuted.
WorldNetDaily reported earlier on Trump’s opinion of Polis, regarding the Peters case.
He had said Polis can “rot in Hell.”
On social media, Trump posted, “God Bless Tina Peters, who is now, for two years out of nine, sitting in a Colorado Maximum Security Prison, at the age of 73, and sick, for the ‘crime’ of trying to stop the massive voter fraud that goes on in her State (where people are leaving in record numbers!). Hard to wish her a Happy New Year, but to the Scumbag Governor, and the disgusting ‘Republican’ (RINO!) DA, who did this to her (nothing happens to the Dems and their phony Mail In Ballot System that makes it impossible for a Republican to win an otherwise very winnable State!). I wish them only the worst. May they rot in Hell. FREE TINA PETERS!”
Trump earlier announced on social media:
“For years, Democrats ignored Violent and Vicious Crime of all shapes, sizes, colors, and types. Violent Criminals who should have been locked up were allowed to attack again. Democrats were also far too happy to let in the worst from the worst countries so they could rip off American Taxpayers. Democrats only think there is one crime – Not voting for them! Instead of protecting Americans and their Tax Dollars, Democrats chose instead to prosecute anyone they can find that wanted Safe and Secure Elections. Democrats have been relentless in their targeting of TINA PETERS, a Patriot who simply wanted to make sure that our Elections were Fair and Honest Tina is sitting in a Colorado prison for the “crime” of demanding Honest Elections. Today I am granting Tina a full Pardon for her attempts to expose Voter Fraud in the Rigged 2020 Presidential Election!”
It’s not the only scandal brought about amid Colorado’s extreme leftist ideologies. Multiple times it has lost at the Supreme Court, wasting millions of taxpayer dollars, in different cases in which it attacked the constitutional rights of Christians. It still is continuing that agenda with yet another assault of members of the faith.
The state also was sued for incorporating “slavery” into its prison system, and one county, Gilpin, had to fork over some $700,000 not that many years ago for referring, in official records, to a black man as “N—– Roy.”
