Pelosi accused of 'rich hypocrisy' for hiding video of Jan. 6 riot

House Speaker Nancy Pelosi is being accused of “rich hypocrisy” for hiding video of the entirety of the Jan. 6, 2021, riot at the U.S. Capitol, and claiming she has sovereign immunity that means she does not have to let the public have the facts about the events of that day.

It is Judicial Watch, a government-watchdog organization, that has been trying to gain access to the video, which comes from hundreds of monitor cameras posted through the Capitol.

Pelosi has refused, so far, to grant any access to the public records.

Judicial Watch now has filed an opposition to a claim from the U.S. Capitol Police department in which it argues that the videos – and related emails and other documents – “are not public records.”

Further, they claim, there is no public interest in their release and “sovereign immunity” prevents Americans from suing to see what happened in their Capitol.

The original lawsuit was filed under the common law right of access because the Capitol Police refused to provide records of the day, and Congress had exempted itself from the Freedom of Information Act requirements imposed on others.

The original case sought emails among Capitol Police officials, the FBI, the Department of Justice and the Department of Homeland Security regarding that day.

Aso sought was video footage from within the Capitol.

Judicial Watch, because of the Freedom of Information exemption Congress gave itself, asked for access under the common law that gives the public a right of access to public records and documents.

“The Supreme Court was unequivocal in stating that there is a federal common law right of access ‘to inspect and copy public records and documents.’ … [T]he general rule is that all three branches of government, legislative, executive, and judicial, are subject to the common law right,” Judicial Watch reported.

“The Pelosi Congress (and its police department) is telling a federal court it is immune from all transparency under law and is trying to hide every second of its January 6 videos and countless emails,” said Judicial Watch chief Tom Fitton. “The hypocrisy is rich, as this is the same Congress which is trying to jail witnesses who, citing privileges, object to providing documents to the Pelosi January 6 committee.”

The watchdog organization already has revealed that multiple audio, visual and photo records have been found regarding the shooting death of unarmed protester Ashli Babbitt.

“The records include a cell phone video of the shooting and an audio of a brief police interview of the shooter, Lt. Michael Byrd. In October, Judicial Watch released records, showing that multiple officers claimed they didn’t see a weapon in Babbitt’s hand before Byrd shot her, and that Byrd was visibly distraught afterward. One officer attested that he didn’t hear any verbal commands before Byrd shot Babbitt.”
